Hazy Legalization

Last December, the 2018 Farm Bill effectively legalized hemp in a gift of freedom stashed behind the Christmas tree like the Red Ryder BB Gun of the American Dream.

The bill also legalized — or at the very least more legitimized — CBD, the nonpsychoactive ingredient in hemp that proponents say eases anxiety, pain, nausea — even the debilitating effects of epilepsy. It doesn’t get you high — but say goodbye to muscle spasms.

And yet CBD’s state-by-state legality remains as cloudy as the Dude’s recollection of Slayer’s ‘86 summer tour. The Dude may abide, but details are still a little hazy.

It’s a confusing cluster-mess to say the least. Technically, the Farm Bill (now law) classifies CBD with minimal THC separately from marijuana — essentially any CBD derived from hemp, not cannabis. In 2018, the DEA issued an internal directive: “The mere presence of cannabinoids is not itself dispositive as to whether a substance is within the scope of the (Controlled Substances Act).”

But anything derived from plants containing more than .3% THC is still classified Schedule 1 — no medical value with a high capacity for abuse. Unlike cocaine, which is Schedule 2 and great for tots!

Regardless of classification changes at the federal level, states are largely left to figure out the legal logistics for themselves. And like gay couples before 2015 who didn’t know if their marriages would be honored when they crossed state lines, CBD users have no clue if they’ll be stripped searched and paddy wagoned anytime they go on vacation.

Seriously. Disney arrested Grandma last spring. In some parts of the country, convent stoner nuns grow weed for Jesus. And in others — you can do serious time for hand cream.
