Terms of Service

These Terms of Service govern your use of this website and your purchase of Bear Blend products. By using this site you agree to these terms.

Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. IT PROVIDES FOR THE BINDING ARBITRATION OF ALL DISPUTES AND CLAIMS, EXCEPT AS NOTED BELOW, IF THE PARTIES ARE UNABLE TO RESOLVE A DISPUTE OR CLAIM IN GOOD FAITH. ARBITRATION IS BINDING AND SUBJECT TO ONLY LIMITED REVIEW BY A COURT. THIS PROVISION SURVIVES THE TERMINATION OF THIS AGREEMENT.

This provision covers all disputes or claims arising out of your relationship with Bear Blend, including disputes arising out of or relating to your purchase or use of any Bear Blend product, regardless of whether they are based on contract, tort, statute, fraud, misrepresentation, or any other legal theory.

Where permitted by law, all such disputes will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its applicable rules. Unless Bear Blend and you agree otherwise in writing, any arbitration shall take place in San Diego County, California. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

Nothing in this section prevents Bear Blend from bringing claims in state or federal court regarding unauthorized resale, export, modification, or tampering of any Bear Blend product.

Where permitted by law, no arbitrator shall have authority to award punitive damages or damages not measured by the prevailing party's actual damages.

Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PURSUE ANY CLAIM OR DISPUTE ON A CLASS, COLLECTIVE, OR REPRESENTATIVE BASIS, OR TO JOIN YOUR CLAIM OR DISPUTE WITH THAT OF ANY OTHER PERSON OR ENTITY, IN ANY LAWSUIT, ARBITRATION, OR OTHER PROCEEDING.

Bear Blend and you agree that any claim or dispute will be resolved only on an individual basis. The arbitrator may not consolidate or join claims of multiple parties and may not preside over any form of representative or class proceeding.
